Privacy Policy for CheckVideo, provided by CheckVideo, LLC (“CheckVideo”).
CheckVideo takes the privacy and protection of personal information very seriously. By using this website or any CheckVideo mobile application (collectively, the “Website”) or the services provided through the Website or otherwise provided by CheckVideo (the “Services”), we may collect information about you, and use and disclose such information, as described in this privacy policy (“Privacy Policy”). In order to access and use the Website or Services, you must agree to our Services Agreement posted on the Website at https://www.checkvideo.com/terms-conditions/ in addition to any supplemental terms for the products you are using. Any capitalized terms not defined in this Privacy Policy are defined in the Services Agreement.
What This Privacy Policy Covers
This Privacy Policy describes CheckVideo’s use of Personal Information and Anonymous Information (each as defined below) that we collect when you use the Website or Services, as well as Images and Data (each as defined below) and information we may use to update the information you provide to us through other means. We collect and use Personal Information and Anonymous Information as described in this Privacy Policy from persons and companies who use the Website or Services. “Personal Information” means your contact information (i.e., your name, address, email address, or telephone number) and any other non-public information that is associated with your contact information. “Anonymous Information” means information that is not associated with or linked to your Personal Information. “Images” means the “live” or recorded video streams, or one or more “still” video images, generated by, or as a result of using, video cameras and other related products that are purchased and installed by you, or on your behalf by a third party in connection with our Services. “Data” means the data produced as a result of analysis of the Images, or from contact, temperature, water, or other sensors, to the extent such sensors are available and supported by the system in connection with our Services.
The Website is not directed to children and children are not eligible to use our Services. Protecting the privacy of children is very important to us. We do not collect or maintain Personal Information from people we actually know are under 18 years old, and no part of the Website or Service is designed to attract people under 18 years old. If we later obtain actual knowledge that a user is under 18 years old, we will take steps to remove that user’s Personal Information from our databases.

Personal Information We Collect
The Personal Information we gather from you helps us learn more about, and provide you with, the use of the Website or Services. We collect the following Personal Information that you submit to us voluntarily:
Our login process requires you to provide CheckVideo with your valid email address/user ID and user generated password. When you register with CheckVideo or otherwise establish an account with CheckVideo, we may ask for the following information, including, but not limited to, your first name, last name, email address, mailing address, telephone number, your account information, time zone, a challenge question and credit card or other payment information when you order Services online. We may also request optional information to support your use of the Website or Services, such as your company name, or office telephone number. When you in set up your account you are given the ability to opt out of receiving information about receive information about products or services that may be of interest to you. This opt-out is in your User Profile Page. If you do not opt-out, we will collect your email address. When you contact us by sending us an email, we will collect any information that is contained in your email. We may collect information about data and other information that you make available to us, such as information regarding your computer or mobile device. CheckVideo may use and store such information and other information on your behalf in accordance with the Services Agreement and this Privacy Policy. You can choose not to provide us with certain information, but this may limit the features of the Website or Services you are able to use.
Information From Other Sources
We may receive Personal Information about you from other sources like telephone, fax or email, from third-parties that provide services for us in connection with the Website or Services, as well as from third-parties to whom you have voluntarily provided information, including an MSP (defined below). We may add this information to the information we have already collected from you via the Website or Services. This Privacy Policy does not restrict our use of that additional information.
Use of Personal Information We Collect
In general, we use Personal Information you submit to us either to administer your account, carry out our obligations arising from any agreement you may have with us, register you for and/or provide you access to the Website or Services, respond to requests that you make, to improve the Website or Services, to better tailor the features, performance and support of the Website or Services, and to offer you additional information, opportunities, and functionality. We use a third-party payment processor to collect payments from you. Your payment account information will be provided directly to such third-party and the use of your payment account information will be used in accordance with such third-party’s privacy policy.
Please be aware that if you enter any Personal Information into publicly available sections of the Website or Services, or if you choose to share any Personal Information, Data or Images with other systems, devices, users or third parties through any sharing features made available as part of the Website or Services, this information will be displayed to anyone who has access to these sections, and you do so at your own risk and sole responsibility. You acknowledge and agree that CheckVideo will not be liable in any way with respect to your distribution and/or sharing of your Personal Information as described in the previous sentence.
We may create Anonymous Information records from Personal Information by excluding information (such as your name or email address) that makes the information personally identifiable to you. We may use Anonymous Information to analyze usage patterns so that we may enhance the Website or Services. We reserve the right to use and disclose Anonymous Information to third-parties in our discretion.
Disclosure of Information
It is our general policy to restrict who can access Personal Information. Within CheckVideo, Personal Information is used on a “need to know” basis only, and is not available to anyone other than our employees, staff and agents. We may also make Personal Information available to government agencies, regulatory authorities and/or financial services partners as required by law or as required to adequately and properly fulfill the duties included within our Service. Except as otherwise stated in this Privacy Policy, we do not trade, rent, or share the Personal Information that we collect with third-parties, unless you ask or authorize us to do so. In the event a third party provides certain Services to you as a monitoring service provider (“MSP”), you hereby authorize our disclosure of Personal Information to the MSP as necessary for them to provide you certain monitoring services. You may revoke this authorization by contacting CheckVideo, at which point we will use reasonable efforts to effectuate such changes promptly. You acknowledge, however, that such changes may not be immediate, and your previous MSP may continue to receive Personal Information during this transition period.
We may provide your Personal Information to third-party service providers who work on behalf of or with us to provide some of the services and features of the Website or Services and to help us communicate with you. Examples of such services include sending email, analyzing data, providing marketing assistance, processing payments (including credit card payments), and providing customer service. These third-parties are required not to disclose your Personal Information and not to use your Personal Information other than to provide the relevant services to us. MSPs follow their own rules and what they do with your data is up to the MSP. You should check the MSP’s privacy policy. Their handling of your Personal Information is not covered by this Privacy Policy.
Although we currently do not have a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, “Affiliates”), we may in the future. We may share some or all of your Personal Information with these Affiliates, in which case we will require our Affiliates to honor this Privacy Policy.
In the event CheckVideo goes through a business transition such as a merger, acquisition by another company, or sale of all or a portion of its assets, your Personal Information will likely be among the assets transferred. You acknowledge that such transfers may occur, and that any acquirer of CheckVideo or its assets may continue to process your Personal Information as set forth in this Privacy Policy.
We may share some or all of your Anonymous Information or Personal Information with our third-party partners, other third-parties to whom you ask us to send or share your Personal Information, or about whom you are otherwise notified and do not request to opt out of such sharing. We provide you the ability to opt-out of receiving marketing materials from us. This Privacy Policy does not cover the use of your personally identifiable information by such third-parties. CheckVideo does not maintain responsibility for the manner in which third-parties use or further disclose your personally identifiable information collected from you in accordance with this Privacy Policy, after we have disclosed such information to those third-parties. If you do not want CheckVideo to use or disclose Personal Information collected about you in the manners identified in this Privacy Policy, you may not use the Website or Services. You may also opt-out of certain uses of your Personal Information in accordance with the section below entitled “Choices Regarding Personal Information.”
We may disclose your Personal Information if we believe in good faith that such disclosure is necessary to (a) comply with relevant laws or to respond to requests from law enforcement or other government officials relating to investigations or alleged illegal activity, we can (and you authorize us to) disclose Personal Information without subpoenas or warrants served on us; or (b) to protect and defend the rights or property of CheckVideo, you, or third-parties. You hereby consent to CheckVideo sharing your Personal Information under the circumstances described herein.
Choices Regarding Personal Information
Registered users may access their account information at any time to update Personal Information contained therein. Subsequent uses or disclosures of information by us will reflect those changes, but we have no ability to update any information previously disclosed to any third-party. Certain information is necessary in order for us to provide the Website or Services; therefore, if you delete such necessary information you will not be able to use the Website or Services.
If you no longer wish to receive promotional communications from us via email, you may select to opt out via the User Profile page made available on the Website and provide the required information, which may include such things as, your full name, mailing address, telephone number and/or email address so that we may identify you in the opt-out process. Within a reasonable time after we receive your request, we will cease those communications and/or remove the Personal Information, as applicable. However, during the term of our agreement with you, we retain the right to send you service-related communications. Please note that even though you may request deletion of your Personal Information by us, we may be required (by law or otherwise, such as to prevent fraud, resolve disputes, troubleshoot problems, or enforce our Services Agreement) to keep this information and not delete it (or to keep this information for a certain time) in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete Personal Information, it will be deleted from the active database, but may remain in our archives. In addition, in the event you sell or otherwise transfer your CheckVideo device to a third party, we will retain a copy of your account information for our records with respect to that device but removes other information (stored video clips and event configuration settings in the Portal). The device, if not factory reset, will retain event configuration data until a factory reset occurs.
Use and Disclosure of Images and Data
All Images and Data are stored either on your local device(s) and attached storage media, or on our servers accessible only by you, individuals with knowledge of your user ID and password and certain of our employees, staff and agents to the extent necessary as contemplated herein. No live video from your system is directly captured or stored at any time by CheckVideo. All continuously recorded video is stored only on your local device(s) and attached storage media. CheckVideo may in the course of providing the Services, store and/or transmit those Images and Data which you elect to upload, transmit and/or share with other systems, devices, users or third parties through any sharing features made available as part of the Website or Services. Access to your Images and Data is protected by a series of security measures, including data encryption, digital certificates, token exchange and requiring user passwords to meet a minimum security threshold. If you have an MSP, we will, however, provide your MSP with access to your Images and Data as authorized by you. If you wish to revoke this authorization or redirect access to another MSP, please contact CheckVideo to do so and we will use reasonable efforts to effectuate such changes promptly. You acknowledge, however, that such changes may not take effect immediately, and your previous MSP may continue to have access to your Images and Data during this transition period. We do not, and our personnel and contractors do not, view, monitor or access your Images or Data, other than with your express permission in connection with the provision of technical support, except to provide the Services to you and as required to comply with applicable law. We may access and make your Images or Data available (a) to government agencies, regulatory authorities and/or services partners as required by law, (b) as required to adequately and properly fulfill the duties included within our Service, or (c) to protect and defend the rights or property of CheckVideo, you or third parties. Except as otherwise stated in this Privacy Policy, we do not sell, share or otherwise provide your Images or Data to third-parties, unless you authorize us to do so.
Anonymous Information Collected Via Technology
As you use the Website or Services, certain information may also be passively collected and stored on our or our service providers’ server logs, such as your Internet protocol address, media access control (MAC) address, browser type, operating system and the firmware and hardware versions that you are using. We also use Cookies and navigational data like Uniform Resource Locators (URL) to gather information regarding the date and time of your visit and the solutions and information for which you searched and viewed, or on which of the advertisements displayed on the Website you clicked. This type of information is collected to make the Website or Services and solutions more useful to you and to tailor the experience with the Website or Services to meet your special interests and needs.
An “Internet protocol address” or “IP Address” is a number that is automatically assigned to your computer when you use the Internet. In some cases your IP Address stays the same from browser session to browser session; but if you use a consumer internet access provider, your IP Address probably varies from session to session. We, or our service providers, may track your IP Address when you access the Website or Services.
“Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing a website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience with the Website or Services. Persistent Cookies can be removed by following your Internet browser help file directions. If you choose to disable Cookies, some areas of the Website or Services may not work properly.
We may also enable advertisers and ad servers to promote third-party products and/or services by placing advertisements on the Website. These advertisers and ad servers may use Cookies and/or “Web Beacons” (which are usually small, transparent graphic images) in order to monitor information related to served advertisements. Clicking on such advertisements will direct you to the website of a third-party and the advertiser. This Privacy Policy does not cover the privacy practices of any advertisers or ad servers.

The Website or Services may contain links to other websites. Please be aware that we are not responsible for the privacy practices or the content of such other websites. We encourage our users to read the privacy statements of each and every website they visit. This Privacy Policy applies solely to information collected by us through the Website or Services and does not apply to these third-party websites. The ability to access information of third-parties from the Website or Services, or links to other websites or locations, is for your convenience and does not signify our endorsement of such third-parties, their services, other websites, locations or their contents.
Feedback
If you provide feedback to us, we may use and disclose such feedback for any purpose, provided we do not associate such feedback with your Personal Information. We will collect any information contained in such feedback and will treat the Personal Information in it in accordance with this Privacy Policy.
Security and Confidentiality
CheckVideo has put in place reasonable physical, electronic, and managerial procedures to protect the integrity and confidentiality of your Personal Information. Despite such efforts, however, please note that no company, including us, can fully eliminate risks or guarantee the security of your Personal Information; unauthorized entry or use, hardware or software failure, and other factors may compromise the security of information about you at any time, and we bear no liability for uses or disclosures of personal data or non-personal data arising in connection with the theft thereof.
Changes in this Privacy Policy
This Privacy Policy is a living document. We reserve the right to modify this Privacy Policy at any time. We will post the changes to this Privacy Policy on the Website, and other places we deem appropriate so that you are aware of what Personal Information we collect, how we use it, and under what circumstances, if any, we disclose it. At our discretion, we may email users who have opted to receive communications from us, notifying them to the changes in our privacy practices. It is your sole responsibility to check the Website from time to time to view any such changes to the terms of this Privacy Policy. Continued use of our Website or Services following notice of such changes will indicate your acknowledgment of such changes and agreement to be bound by such changes. If you do not agree to any changes, if and when such changes may be made to this Privacy Policy, you must cease access to the Website and use of the Services.
